TERMS + CONDITIONS
Welcome to Klub Verboten. Any access to and/or use of this website and our services is governed by the Terms and Conditions as set out below and by the Privacy Notice.
About Klub Verboten
Klub Verboten is a members club.
Please read these Terms and Conditions carefully. They set out the basis on which you are allowed to use our website, and the additional terms that apply and services you can receive if you are a registered member of the club or a ticket holder to an event hosted by Klub Verboten. If you have any questions regarding these Terms, or the use of Klub Verboten, please feel free to contact us by email.
You might want to print a copy of these Terms and Conditions for your own records. The privacy of your personal data is important to us. Please see our Privacy Policy, which forms part of these Terms, for details of how we will use and process your personal data.
If you are accepted as a member of the Klub Verboten members’ club, or you hold a ticket to a Klub Verboten event, the additional membership related provisions will govern the terms of your membership. We may update these Terms from time to time for legal or regulatory reasons, or to reflect changes in our services or practices. We will endeavour to notify you of any material change that affects you. You should also regularly check this page to see if any changes have been made.
Membership
General membership terms
Klub Verboten is a members’ club. We reserve the right to accept or reject any and all applications for Membership at our sole discretion.
You must be 21 years or older to apply to become a member of Klub Verboten.
Membership termination
You can cancel your membership at any time by unsubscribing from our newsletter or by emailing us at the address displayed at the bottom of this page.
We may terminate your Membership at any time if in our reasonable opinion you have breached any of these Terms and Conditions, or the Klub Rules. In such circumstances, the termination will take effect immediately and you will not be entitled to any refunds. We may also terminate your Membership at any time in our absolute discretion to take effect immediately.
Admittance to events
Allocation of tickets and admittance to Klub Verboten events is at our sole discretion. Some events are open to all, while some events are open only to members, or to members and friends. Please check the corresponding event description for details on the events you wish to attend.
Klub Membership or holding a ticket does not guarantee that you will be permitted entry to an event. Our door staff reserve the right to refuse any ticket holders admission at their discretion.
Reasons for non-admission to an event may include, but are not limited to, our door staff having a genuinely held belief
that you:
+ have not complied with the Dress Code;
+ have been denied membership, or had your membership suspended;
+ have not yet been granted membership and cannot demonstrate a comprehensive understanding of the Klub Rules;
+ have been ejected from a previous or similar event;
+ have been the subject of a behavioural complaint at a previous or similar event;
+ have been disrespectful to our staff or other guests;
+ are overly intoxicated; or
+ have otherwise demonstrated that you present a risk to our community or licencing conditions.
In cases where we refuse admittance to an event, we will endeavour to provide a refund of the ticket price within 30 days of the event, except in cases where there has been a clear failure to adhere to the dress code, or where the ticket holder’s membership has previously been rejected or suspended. We endeavour to provide reasons for non-admission
where it is practical to do so.
For more information about our event admittance policies, please ensure that you carefully review our Door Policy, Dress Code, and Event Details documents.
Confidentiality clause
As a Klub Verboten members or event attendee, you agree to respect the privacy of other members and attendees, and agree not to disclose happenings in the club or other members attendance of the club to people or organisations external to the club.
Press, media, and reporting
You must not attend Klub Verboten events for the purpose of media reporting without the prior written permission of the club owner.
Refund policy
If you are unable attend an event for any reason, Klub Verboten will not refund the cost of your ticket.
If you are unable to attend an event which you have purchased a ticket for, you may be granted the ability to resell your ticket to another attendee. This option becomes available when tickets for an event sell out. If you opt to put your ticket up for resale, it will be offered to the first person on the waiting list. If your ticket is re-purchased by another attendee, you will receive a refund for your original purchase within 5-10 days. If no other potential attendees re-purchase the ticket, you will retain it and we will not offer a refund.
If you are refused entry to an event, or we cancel an event, Klub Verboten will refund the cost of your ticket. Klub Verboten withholds the right to refuse to refund your ticket in the event that you were in breach of the Dress Code, have previously been denied membership to Klub Verboten or entry to Klub Verboten events, have been ejected from previous events, or have been banned from attending events.
No refunds can be issued for any patron who is non-compliant with our Door Policy or disregards the advice of our door staff. If a ticket holder is denied entry by door staff and attempts to queue again, no refund will be issued.
If a patron is denied entry and other ticket holders in company decide not to enter, no refund can be issued to the ticket holders who voluntarily decided not to enter. Further, no refunds can be issued to patrons who we are forced to remove from the premises.
Klub Verboten reserves the right to make last minute changes to the location, content, structure, or any specifics relating to a planned event without issuing a refund to ticket holders.
In no circumstance will Klub Verboten be liable for any other costs incurred by you including, but not limited to, travel or accommodation costs to attend an event.
Indemnification
By becoming a Klub Verboten member, or by attending one of our events, you agree to be held responsible for and indemnify Klub Verboten against, any claims, liabilities, damages, costs, or expenses suffered or incurred by us as a result of your breach of these Terms, or of any applicable laws.
Klub Verboten hosts events where attendees may choose to use the spaces and equipment provided to engage in BDSM-related conduct, fetish play, or other sexual interactions. All such interaction between yourself and other attendees, members, or guests is undertaken at your own risk. Klub Verboten may not be held liable for harms arising from any such interaction on our premises or at Klub Verboten events.
